Children and teenagers in England and Wales have been banned from using sunbeds under new legislation. Businesses who fail to comply with the new rules could be fined up to £20,000 if they allow under-18s to use their sunbeds. The Sunbeds (Regulation) Act 2010 comes into force after research published earlier this week showed more than two people under the age of 35 are diagnosed with the deadliest form of skin cancer every day in the UK. Businesses will not be forced to ask for ID or keep a register of customers under the rules. Instead, it will be up to local authorities to decide how to check businesses are complying with the law, such as unannounced spot checks or pre-planned visits. Councils will also have powers to react to concerns from members of the public about under-age users. However, the Chartered Institute of Environmental Health (CIEH) said the ban did not go far enough and called for further measures similar to those set to be introduced in Wales. From October 31, regulations in Wales will further require the use of sunbeds to be supervised; under-18s will be banned from hiring or buying sunbeds; and any adult wishing to use a sunbed would need to be provided with protective eyewear. This new law will go some way to help reduce one of the biggest cancers among 15 to 24-year-olds. UK Public Health Minister Anne Milton Figures show that on average, 6% of 11 to 17-year-olds in England use sunbeds, rising to 50% of 15 to 17-year-olds girls in Liverpool and Sunderland. UK Public Health Minister Anne Milton said: "Cases of skin cancer continue to rise each year. "This new law will go some way to help reduce one of the biggest cancers among 15 to 24-year-olds. "We want to protect under-18s from the dangers of sunbeds and reduce the number of young people getting skin cancer. "My message to young sunbed users is clear: you are putting your health at risk. "Intense bursts of UV radiation can cause damage to your skin, even after just one use." England's chief medical officer, Professor Dame Sally Davies said: "The scientific evidence is clear - sunbeds increase your risk of getting skin cancer, with an estimated 100 deaths a year from skin cancer as a result of people using sunbeds. "Skin cancer is one of the most common cancers in the UK. "Damage to the skin from artificial or natural sunlight can take years to develop and young people are particularly vulnerable, which is why I welcome this new law that protects the under-18s." A 2009 study by Cancer Research UK, commissioned by Welsh Assembly health minister Edwina Hart, found 8.2% of children in Wales aged 11-17 had used a sunbed at least once. Another 16% said they may use one in future.
The Sunbeds (Regulation) Act 2010 enacted a ban on salons being able to provide indoor tanning services to those under the age of 18 in both Wales and England. The Act stipulated the tan ban would “come into force” one year from its passage.
The fine for businesses found in violation of the new measure could be a hefty one – with a fee of as much as £20,000. At press time, the U.S. dollar was the equivalent of approximately .61 British pounds sterling.
Local authorities have been charged with monitoring compliance and any related inspections. The Act made no provision for salons to ID customers for age, nor to maintain any record of such customer information.
Wales has additional regulations that will take effect in October 2011; some anti-tanning constituents are hoping to expand the expanded requirements to England and other European countries. These include:
• salons providing protective eyewear for customers
• all tanning sessions to be supervised (as opposed to an unmanned salon)
• no home equipment sales to those under the age of 18
• display and availability of certain health-related information to tanners
• prohibition of displaying or providing any health-related information to tanners beyond what is provided

Bill passed in Westminster The Sunbed Bill passed in Westminster today will do no more than ban under 18s from using sunbeds in commercial tanning salons. It will not prohibit under 18s from purchasing or hiring sunbeds for home use and does not outlaw unstaffed tanning salons where under 18s can use them. These latter two issues are subject to further regulation which may never happen. Inevitably, under 18s who use tanning salons will home hire or walk into an unstaffed salon where the abuse of sunbeds is more likely to occur. The Bill will come into force in 12 months - around April 2011.
The Association supports a ban on under 18s but lobbied for this Bill to be deferred so that a more constructive and effective Bill could be promoted. The Association expressed concern that this Bill was rushed through within time constraints and would do little to prevent sunbed use by under 18s.
Furthermore, the Association pushed for a further safety measure to be included in the Bill - a maximum UV output level adopted by the EU several years ago but yet to be fully implemented in the UK. This would have made sunbed use safer for all users and the Association was disturbed that this was ignored.
